1. COMMERCIAL POLICY AND PURCHASE REQUIREMENTS

Tenuta Castelvecchio offers its products for sale on www.tenutacastelvecchio.it and carries out e-commerce activities with end users (hereinafter referred to as “Customers”). Tenuta Castelvecchio reserves the right not to accept and not to process purchase proposals that do not come from Consumer users (meaning natural persons acting for purposes unrelated to any business or professional activity) and that, in any case, do not comply with these General Terms and Conditions of Sale.

These General Terms and Conditions of Sale exclusively govern the offer, transmission, and acceptance of purchase proposals for products on the website between users of the website and Tenuta Castelvecchio.

These general terms and conditions of sale do not govern the supply and/or sale of products by parties other than Tenuta Castelvecchio, which are present on www.tenutacastelvecchio.it through links, banners, or other hypertext links.

1.1. Prohibition of Sale to Minors

The sale of alcoholic beverages is strictly prohibited to minors under the age of 18.
By placing an order on www.tenutacastelvecchio.it, the Customer declares and guarantees that they are of legal age and have the legal capacity to enter into a purchase contract.
Tenuta Castelvecchio reserves the right to cancel the order and not to proceed with delivery if there are doubts about the purchaser’s age.
Upon delivery, the courier may request a valid identity document to verify the recipient’s age.

2. HOW TO PURCHASE AND CONCLUDE THE CONTRACT

The display of products constitutes an offer to the public and does not entail any obligation for the viewer until the procedure is concluded by clicking on “complete order.”

To purchase one or more products, the user must select them one at a time and add them to the “shopping cart.” Once the selection of products is complete, the user can view them all in their shopping cart, which will also show the essential characteristics of the selected products and their prices.

The sending of the order by the Customer constitutes a binding contractual proposal. The contract shall be considered concluded only and exclusively when Tenuta Castelvecchio sends the Customer, to the email address indicated, an order confirmation email containing a summary of the purchase, these General Terms and Conditions of Sale, and shipping information.

The customer may only purchase products available on www.tenutacastelvecchio.it at the time of placing the order, as described in the relevant information sheets. The information accompanying the products is that provided by Tenuta Castelvecchio. The images on www.tenutacastelvecchio.it are provided to the customer to facilitate product recognition and are to be considered purely illustrative.

3. PRODUCTS, PRICES, AND PAYMENTS

Only top-quality products are offered for sale on www.tenutacastelvecchio.it Each product is accompanied by a detailed description.

Product prices are expressed in euros, include VAT, and may be subject to change. Before placing an order, users are therefore invited to verify the exact final sale price, which includes any shipping costs. The sale of products on www.tenutacastelvecchio.it is subject to the rules laid down by legislation on conformity and commercial guarantees for consumer goods in accordance with EU and national legislation.

3.1. Secure Payments

4. SHIPPING AND DELIVERY

Orders are shipped Monday through Thursday from 8:00 a.m. to 5:00 p.m. Orders placed on Friday and during the weekend will be processed starting the following Monday. Tenuta Castelvecchio delivers its products through specialized couriers.

4.1. Shipments in Italy

Shipping costs are €9.90 for all of Italy.

For orders equal to or greater than €99.00, shipping is FREE.

4.2. International Shipping (EU and Non-EU)

For shipments outside of Italy, the Customer is invited to request a quote in the appropriate section, as it is not possible to proceed with a direct purchase through the online shop. Orders from foreign countries will not be processed immediately. Tenuta Castelvecchio will notify the Customer by email of the actual shipping costs and any surcharges. The order will only be considered accepted after the Customer has explicitly accepted these costs.

4.3. Delivery Inspection and Transport Damage

Upon delivery, the Customer is required to carefully inspect the packaging. If the package is visibly damaged, wet, tampered with, or if fragile items (such as bottles) are suspected to be broken, the Customer has the right to:

  1. Refuse delivery and promptly notify Tenuta Castelvecchio by email (info@tenutacastelvecchio.it), quoting the order number.
  2. b) Accept the goods with specific reservation, writing “ACCEPTED WITH SPECIFIC RESERVATION – (Description of damage, e.g., wet package/suspected breakage)” on the courier’s receipt before signing.

 

Acceptance of the goods without specific reservation or refusal makes it more difficult to handle a claim for subsequent transport damage. The Customer’s right to avail themselves of the Legal Guarantee referred to in paragraph 6 remains unaffected.

5. CUSTOMS

If the products ordered are to be delivered to countries outside the EU, they may be subject to import duties and taxes. These costs cannot be calculated in advance and are entirely borne by the Customer. Customs costs and import taxes are added to the shipping estimate referred to in point 4.2. and are not included in the product price or in the transport cost communicated by Tenuta Castelvecchio. The Customer is required to check in advance with the customs authorities of the country of destination.

6. LEGAL WARRANTIES

The sale of products on www.tenutacastelvecchio.it is subject to the provisions of the legislation on legal guarantees of conformity and commercial guarantees for consumer goods pursuant to EU and national legislation (Legislative Decree 206/2005, Consumer Code). The Legal Guarantee of Conformity is valid for two years from the delivery of the goods. In the event of a lack of conformity (e.g. wine with a “corked” taste, defective, altered), the Consumer Customer must send a written report by e-mail to info@tenutacastelvecchio.it within two months of discovering the defect, attaching photographic or video documentation of the defective product. Tenuta Castelvecchio guarantees that the products delivered will be identical to those indicated and described on the website www.tenutacastelvecchio.it  The manufacturer is liable for all products sold. The manufacturer is also responsible for the accuracy and completeness of the information provided on the packaging.

7. REPORTS OF DAMAGE, DEFECTS AND NON-CONFORMITY

In the event of a lack of conformity, damage resulting from transport (e.g. broken bottle) or missing items, the Consumer Customer is required to send a written report no later than 48 hours after receipt of the goods.

Complaints and reports must be made by email to info@tenutacastelvecchio.it, quoting the order number in the subject line and attaching photographic or video documentation that clearly shows the damage or defect.

If the damage was visible upon arrival, it is essential that the Customer has followed the procedure for acceptance with reservation or refusal set out in point 4.3. Tenuta Castelvecchio undertakes to handle the report and find a solution as quickly as possible.

8. RIGHT OF WITHDRAWAL (RETURNS)

The Consumer Customer has the right to withdraw from the purchase contract for any reason, without providing justification, within 14 calendar days of receiving the goods, in accordance with fairness and good faith, subject to written notification to be sent to info@tenutacastelvecchio.it.

In the notice of withdrawal, the consumer customer shall, in addition to expressing their intention to exercise this right, indicate the order number that gave rise to the sales contract from which they intend to withdraw, the tax document number and details of the products for which they intend to exercise this right. The right of withdrawal is reserved only for the end consumer, understood as a natural person, excluding purchases made by persons who purchase for resale to third parties (professionals/companies).

8.2. Conditions for Returns and Costs

  • Consumers who wish to exercise this right must be aware that the purchased goods must be returned completely intact in order to exercise this right.
  • The methods and costs of shipping for returns are entirely the responsibility of the Consumer Customer, including any suitable packaging. In the case of returns from non-EU countries, any customs charges for returning goods to Italy shall be borne by the Customer.
  • Goods must be returned within 14 days of notification of withdrawal to the following address: Immobiliare Castelvecchio Srl, Via delle Mannelle n° 19, 59011 Loc. Seano – Carmignano (PO) – Italy.
  • www.tenutacastelvecchio.it reserves the right to assess the goods to exclude the presence of alterations, damage or tampering and, in any case, any problem that may have compromised the integrity of the goods.

8.3. Exclusion of the Right of Withdrawal

  • The right of withdrawal is excluded in the cases referred to in Art. 59 of Legislative Decree No. 206/2005 (Consumer Code) and subsequent amendments. By way of example, the following cases in which the right of withdrawal referred to in the previous article is excluded are indicated: the supply of goods that are likely to deteriorate or expire rapidly, the supply of sealed goods that have been opened after delivery, the supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on market fluctuations that cannot be controlled by the trader.

8.4. Refund

  • If the right of withdrawal is exercised in accordance with the terms and conditions set out above, the Seller undertakes to refund all Payments received from the Consumer Customer as soon as possible and in any case within 14 days of receiving notice of withdrawal. • The Seller may withhold the refund until it has received the Product or until the Customer has provided proof of return, whichever occurs first.
  • The refund will be made using the same method as the original payment (bank transfer, PayPal); if this is not possible, it will be refunded by bank transfer.

9. Limitation of the seller’s liability

The Seller is only liable for direct damages caused by wilful misconduct or gross negligence. It is not liable for indirect or consequential damages, such as loss of profit, business interruption or damage to reputation.

In any case, the Seller’s total liability shall not exceed the amount paid by the Customer for the Product concerned.

The Seller shall not be liable for damages resulting from:

– Delays due to force majeure or the carrier,

– Improper or non-compliant use of the Product.

These limitations do not apply to personal injury and do not reduce the Customer’s mandatory rights under the law, including the legal guarantee of product conformity (Articles 128 et seq. of the Consumer Code).

10. Force majeure

The Seller shall not be liable for delays or failure to deliver due to events beyond its control, which are unforeseeable and unavoidable, such as wars, strikes, natural disasters, health emergencies or transport problems.

If such events last more than 30 days, both the Customer and the Seller may terminate the contract by written notice. In this case, the Customer is entitled to a refund of any amount already paid for undelivered products.

11. Privacy and applicable law

Users are invited to carefully read the section of the Website dedicated to the Privacy Policy and Cookie Policy, which contains all information relating to the processing of personal data. These General Terms and Conditions of Sale are governed by Italian law. The place of jurisdiction in the event of any disputes is Prato.
